I was involved in a car accident the other driver was ticketed for driving without lights that contributed to wreck, and also a suspended DL. It was nighttime also. the crash report I had no contributory neg on my behalf. There was 2 other witnesses that told the same story as me to police. His insurance co. is refusing responsibility for the last 4 weeks. How long can they stall paying this.

Driving without lights and on a suspended driver license is perhaps meaningless unless the driver was otherwise negligent in causing the collision. The police report is not a determiner of negligence as far as the other driver's insurance company is concerned. If they don't believe their insured was at fault, they don't have to pay.
Instead, you will have to sue the at-fault driver (and the registered owner, if different) for your total damages -- probably a small claims matter. If you win, then the insurance company will have to pay ASAP.
