Question:
My wife and I purchased a Bankers Medicare Supplement Insurance Plan were their agents told us that we would be covered for pre- existing conditions. My wife had a stroke in 11/2012 and I was in a serious car accident in 11/2013. In our multiple discussions with their agents we explained the needs to continue therapy and for yearly medical tests. We were assured that we would be covered. A few months after we started therapy and my wife had all of these tests done we started to receive notices that we were not covered. The agent was supposed to look into it but as of this date they still have not paid anything. Can we sue the agent and the company for payment and misleading us with this policy?

Yes. I could sue you for no reason. Winning is a different matter. Your question is one purely of a legal matter. This is an insurance forum.

This is a typical case of misrepresentation, possibly even fraud, on the part of the agents. The insurance company can be held responsible for their negligent acts.
There are a number of factors that can weigh in your favor when it comes to Medicare Supplement insurance. However, a public forum such as this is not the appropriate place to discuss the possibilities. Please contact me privately. This is exactly the kind of case in which I have had great success as an expert witness in the past 4-5 years.
