Act of God

Hi,

Can anyone offer any advice regarding Act of God?

2 slates came off my neighbor's roof causing £470 worth of damage to my car. Where do I stand with the insurance company saying Act of God ?

Anyway out of this? What if I don't believe in God? I am not a happy bunny...

Hi !
Letz be very clear at one thing that these so-called 'Acts Of God' are in reality nothing but some accidents that occur as a result of some magnified natural influences. Examples of an act of God are:
• earthquake
• flood
• hurricane
• lightning
• tornado

I could empathize with you at this !
I once had a rain leakage problem through a defective roof at my neighbor's place.
Believe me, these are not instances of unforeseen or natural setbacks of extraordinary measures. These are pretty much foreseen examples and could have been avoided through exercising a bit of caution. These are mere consequences of utter negligence due to which the party suffering from the accident should be entitled to damages. So don't you need to worry at all my friend.

Did you balance your case with a true 'Act Of God' ??
I think by an 'Act Of God' , we indicate any event that is unique and limitless in its stretches. It is something presumed to have a catastrophic effect which can't ever be counted upon or be avoided by an human effort. We can only look forward to such measures of destructions caused by events like tornadoes, floods, tropical storms and also fires only if it is caused by lightening. Hope, you got that clarified! I'm guessing there was a storm in the area with high winds? If so, _and_ it cannot be shown that there was some prior problem with the shingles, I'd agree that the other person is not liable/responsible.

The situation was beyond your neighbors control. He/she maintained the roof as they should be doing and nothing (reasonably) could have been done to prevent this from happening.

there was a tree in the middle of the road a big truck comming in other lane there was no where to go so the tree took the top of my car off when I got out to look at my car there was a dominos pizza sign under my car that driver all ready hit it should the county be somewhat responsible for not sending sombody out there ?

Thumper, it's better to start a new thread when you have an unrelated post as not to "thread cap". Punctuation would be helpful as well.

First, the government has what is called sovereign immunity ("the king can do no wrong"). This means that they cannot be held liable. But this has pretty much been ignored and if they have ever paid something to someone, they need to continue to do so. So most communities will have a liability policy for this reason.

The question is... did the city/county know about the tree and did they have time to go out and remove it from the road? I'm betting they did not. Well, as mentioned above, they cannot be responsible for something they had no control over. They can only know about these situations when they see them or someone calls to tell them. They then need the opportunity to get out and remove the tree. I'm guessing this was not the only issue they were addressing after a storm.

Also, did they even own the tree that fell over (was it on public property)? Probably not.... so if it fell for a reason within someones control (rotten and the owner knew it was going to fall) then the city/county would not be responsible, it would be the owner of the tree.

Proving either of these situations would be next to impossible.

Beyond that, there is a question as to why you did not see a large tree laying in the road way. Was it not obvious? It appears that you may have been able to avoid the situation but for whatever reason struck the tree.

Would the county be responsible in this situation? _Extremely_ doubtful.

In my opinion, this incident does not contribute to any event with a catastrophic effect. Thats reason enough to keep it from terming it as an 'Act Of God'. In your case this is perfectly a matter that needs to be settled between you and the offender's insurer, if whatever you depicted is perfectly in shape!
