Can I file a claim?

My neighbor's car was set on fire by somebody he had conflict with. The person who set the car on fire poured gasoline all over the car and torched it. The person hasn't been caught yet. My car was parked beside the car that was set on fire and damaged by the flames. All I have is liability so my insurance company want fix the damages. My insurance company said I would need to have comprehensive insurance which covers arson. After speaking with the fire marshall and police officer I was told I could put in a claim against my neighbor's insurance company since his car being on fire caused damage to my car. Is this true? Can I put in a claim with my neighbor's insurance company to get my car fixed? I was thinking since it was no fault of my neighbor his insurance company can't be held responsible for the damages.

Your correct on both accounts... you can put a claim against that person's carrier (as it's a free country) and they can (and 99.9999% sure) deny it.

The other person's policy will pay when their insured becomes legally liable for damage. In this case he/she was not liable... an unknown 3rd party was. About the closest this could come to getting covered is if yur neighbor knew this person was going to set his/he car on fire but you'd also still have to prove it. There is really no chance of that.

My advise... if the other person does not move... move yourself. Setting someone's car on fire means both these people have some _SERIOUS_ issues! It's not a big step to set a house on fire next. Obviously the person who set the fire does not give one care about the additioinal damaged caused by their actions. The car could have _easily_ exploded and caught several houses on fire.

I think I have to agree with Tcope here. You should prob move or at least try and figure out who actually cause this to happen. That is a serious matter and someone could have def gotten hurt. I would ask the police what you can do to prevent this from happening agan and try and find out who did it.

sry to say this but ur case is really a difficult one as told by Tcope here. i think there no real way in which u seems to be getting the desired result that is company can /im sure it will deny ur claim if u file it

You may have better luck with homeowners insurance if you or your neighbor own these residences...

Sorry to say this, I think insurer won't accept your cliams.
