Help with beneficary question...

by lindoyle » Sun Sep 30, 2007 02:41 pm

Has anyone ever had an insurance company to lose a beneficary paper? My mother-n-law had changed all her insurance beneficarys, etc several years ago, now we find one of the forms was not changed according to the insurance company BUT at the time of her death she thought they all had been changed. We have sworn statements showing her wishes from several people. The beneficary that is on the paper and she had not spoken in approx 20yrs...It is not a large amount of money, but do we go go against her wishes and let her have it, or what do we do???? How do you fight an insurance company????? It is not the money, it is her wishes we worry about...My husband & I were taken care of. Thanks for any help....

Welcome to the Community :D So, she had not spoken with this person in 20 years- is that when she changed the beneficiary or thought she had?

So, did she just think they had changed it, or they did, and don't have it recorded? I'm not an expert, but I would think that if she never had it changed, it would be hard to fight-saying that that wasn't her intention- but I don't know. Someone with more knowledge will come along and give you some answers..

Very true Karen, sometimes it is about knowledge and sometimes it is all about facts! The most important thing over here being whether her mother-in-law had intended to make a change to her earlier enlistment or is it that she had actually changed it as regards her documents. I truly feel lindoyle should find out the truth in this regard fully on the basis of data lying with the form. Certainly if she has this notification that it has been altered, then it has to be on papers rather then being verbal. Isn't it ?

lindoyle, good morning and welcome,

had changed all her insurance beneficarys, etc several years ago

I think this would go a long way to PROVE her intent and that she did change the bene, but they lost it. I would get this PROOF (changes in other policies) together and show that as evidence as well.. Contact your states dept of insurance and ask to speak with a consumer advocate and see how you should go about this.

Good luck, and I'm sure someone with 'life' claims/policies will come along and help out, that is not my area of expertise.
