VICTIM OF POLICE CHASE CRASH .. HELP!

Good morning Rod and welcome to the community...lets try and sort this out......I'm sure others will come along as well and offer additional opinions.

First of all I'm glad you're ok, and sorry this happened.

Secondly, thank you for assuming some responsibility re: your lack of insurance, you would'nt believe the people and excuses they make up rather than realizing and admitting

I really messed up on that one.

waiting on a lawyer I hired who says was waiting for a full police report last I spoke to him.

Hi Rod, thanks heaven you are safe. These types of chases often lead to fatal accidents. Crooks, while chased by the police, drive like hell. And innocent people, at times, have to pay the price for it.

Well, the chances of recovering the damages from the other party's insurance, in case of stolen vehicles are almost impossible. The car owner's insurance will not cover the damages as they'll adjudge it as ‘non-permissive use of the vehicle'. Therefore, the victim is left with the only option of turning the claim to his carrier.

However, take pictures of the damaged car and obtain at least two quotes from the body shops and file a claim against the police agency. They may either negotiate the claim themselves or may direct you to the right office. But, as I have mentioned above, the chances are pretty slim.

I wish you all the luck. This is just not the right thing to happen before the Christmas. :(

I won't say you should have had insurance but I have to wonder... you hired an attorney (perhaps free) to look out for your interest but did not have the money to pay for liability insurance to protect _others_ from your actions?

I still question why you would pay an attorney to handle this matter. There is really nothing he can do that you can't. You need to contact the prosecuting DA and ask them to pursue your loss. You then should probably show up when this person stands before the judge and show the judge your documented loss and ask him/her to address this matter. The judge could do many things... require the suspect to settle the loss before _any_ breaks are allowed, impose all sanctions possible until your loss is settled, etc.

You could also file suit in small claims court and obtain a judgement against this person. But then you'd have to attach this to property that the person owed. It's a long shot that you'd get anything for your troubles but it's possible.

In the end it's doubtful that this person will pay any restitution, sadly.

tcope, I said to myself ..''ok, in a couple of days i'll have the money to get back my insurance.. i'll be out of this hole and everything will be back to normal.'' Out of no where this jerk almost kills me and leaves me at ''0''! I never thought this could happen, I was very careful. If anyone reading this is in a tight situation, don't make the same mistake I did.
I had no idea on what to do or what was next, what would happen. I was never in an accident, specially one involving the police and a couple of thieves ... you see this in the movies. That's why I got a hold of a lawyer, however I did not pay him, Its the type that you pay if there is gain. So, no I didnt have the money to have my policy up to date neither did I have it for a lawyer.

Talk about bad luck Rod, getting hit and getting hit by someone who in a stolen vehicle, really sorry to hear this happened to you and even happier to know that you are okay.

Cases like this really irritate me, some one should be held responsible, does the city of orlando have a crimes victims fund set up? I know here in Pennsylvania, there is such a thing, and in New Jersey also. The one in New Jersey just reimbursed my friend for funeral charges for her sister that was killed by a homeless man. I know the comparision is really out there. But my point is "You are a victim of a crime" I would ask the District attorney office about this fund and see what is out there. Also, I don't know if there is anything set up with your state with the uninsured/underinsured motorist, you may want to inquire about that also. I am just throwing out some possibilities for you. I hope you get some kind of compensation for this, goodluck and keep us updated please. Hang in there, glad to hear that you are ok.

Rod for what it's worth...we all understand tough times...I'm (and sure you are as well) just thankful that it wasn't your fault, and that you didn't have a child, girlfriend, mom or anyone else that was seriously hurt or killed with you...then rather than anger you would've felt guilt (for not having uninsured motorist coverage at least to address their injuries)...This is a terrible thing that has happened to you and I hope some good will come from your story. And people will realize that even going without coverage for one minute that their vehicle is on the road can cause irrevicable damage. And you don 't have to have done a thing wrong...Just paying your toll!!! ...Again I'm so sorry, (and believe me I wouldn't be so 'easy' on you had you been at fault and uninsured...ask anyone! :wink: )....contact the prosecutor as tcope and I have suggested...also as good natured indicated some counties have a victim fund...please do keep up updated....although this is a very difficult situation for you...Still you have a lot to be thankful for....(you made it out alive!)

So true Lori, when we hear of others heartaches and headaches if we are smart we will listen and learn.

Rod, I tried to find information for you on a crime victims fund in Orlando, there are some there, just not sure what all they apply to. You can attempt googling it yourself and see what you come up with. Are the police and the District attorney being cooperative to you or are they taking the stand on you being uninsured. Hope they are being helpful. Bad things happen to good people.

This is a long shot, but and Lori help me out here. What about the drivers of the vehicles and the other insurances in their households? Just reaching out here. What do you know about the other drivers, were they teens, are they on a parents policy? Would there be anyway of finding out this information as far as what other insurances in their place of residence might help out.
