Am I at fault?

I was backing out of a parking space and someone stopped behind me to talk to a friend. She was pulled up enough so that when I looked over my right shoulder I could not see her. I did not look over my left shoulder because it was a one way and there should not have been anyone there. In backing up I clipped her bumper. Would this be my fault or her fault?

Yup, 100% all day and every day.

You have a duty to make sure the area behind you is clear. There was a breach of that duty. You tried... just not enough. The other person had not opportunity to avoid the accident.

I don't doubt that this was just a mistake on your part and it was not a big mistake but it just happened.

(I think?..) If you back up into someone it's AUTOMATICALLY your fault. That same thing happened with me. My friend was parked IN FRONT of me, in a parking lot. We BOTH got into our cars, to go somewhere. She ASSUMED I had already starting backing up, to let her out of the space. She started backing up first. She hit my front bumper. It din't do ALOT of damage...just a noticable dent. I had an older car ( a 1987 Baretta) So, I wasn't REALLY worried about it. She DID turn it in to her insurance company. I don't know why, but, I guess she thought this accident would be MY fault bacause I was at a 'standstill.' Needless to say. her payments went higher, for her policy. YEP...her insurance company said it was HER fault.
