I got into an accident on 10/13/07 and my car was totalled. I ended up having to go to the doctor and getting pt. CAT was done and the dr basically states I've reach max recovery. I did not get an atty because I believe I didn't really feel it was necessary. It's now been several months and I still have pains. My adjuster want to close the UM claim and I decline his offer for settlement...what is my next step and or options in ensuring that I still have coverage for my on going aches and pains.

:shock: Am I to understand that you are saying they offered you 400 knowing your diagnosis and prognosis? Is that correct? If so, you may (in this case, which I rarely recommend) want to consider an attorney. 400 is an unreasonably low first offer....in fact I think insulting...

I wonder if the poster meant $4000 here. $4oo does seem very riduculous. It also seems to be on the really low side with over 9k in bills. That is just my opinion. Is there any truth to the saying that a claim value is worth three times med. bills?

that used to be a way to kind of figure one...most companies have gotten away from that and individually evaluate them on their own merit, which really makes sense, you can run a ton of bills up in just diagnostic charges....but when i started (1987), it was pretty common to figure your range right around med bills times 3...but no more!

just to clarify...the original offer was $400 (four hundred). I live in Florida - all my med bills are already paid by PIP and med pay. I still have some $$$ left there but like I said...I don't know if I will still need add'l treatment. PIP also already paid all my time off/medicine/mileage.
I think the 400 was to settle the um portion....
