Hello,
Can insurance company not pay for rebuild the house after the fire?
House is total. They are saying that during the fayer the owner, my son was not in New York. House was never vacant. Me and my husband also lived in the house. He left on November to Vegas for a new job and he was on a probation for 3-6 month. Fire happened in January. He dos not have a residency in Vegas or any other place. Now insurance company dos not recognize him as a resident of that address. And sans he is not we do not exist. Insurance company agent new that he is living for a new job and by his advise he had to get a Vegas driving liense.
Can they do this?

First, have your son call the NY Dept of Ins and file a complaint. The complaint is that "not in New York" is not an exclusion to a fire loss. Then have your son call the insurance company and ask them to point out the "not in New York" exclusion under the policy.
Find a Proof of Loss form online (ClaimsPages.com). Have your son complete this form and mail it to the his insurance company. They than have 30 days to pay the claim, deny the claim (correctly) or come up with a reason why they need more time.
The denial sent is not a valid denial. As I mentioned, there is no "was not in New York" exclusion to a fire loss. People are usually _not_ home when a fire starts. Many times they are not in New York. I keep mentioning NY as no where in the policy are coverage going to be excluded for not being in "New York". This would make no sense to 99% of the people that are insured with that company. Why would a policy exclude coverage for everyone not specifically in New York.

I can not belie that I can get some cine of help with out paying for it.
But, dos it meter that he has Vegas drivers license at the time of fire. He had to change it by Vegas Low, or each time police stops him, he wold get $1000 fee.
Insurance Company made a fuss over that also. My son send them a Vegas Low papers.
We red over and over the policy, and no where it mentions that a person has to be in the State by the time of the fire to be covered.
