Two questions, please:
1) If a California employee is laid off while on disability, can he apply for unemployment once he's able to work again? (FMLA has expired, so the person no longer has FMLA job protection.) The layoff is due to cut-backs at the company and affects multiple employees. The disabled employee is not being singled out.
2) If the disabled employee voluntarily elects to move up their final date of employment, how does that impact later eligibility for unemployment benefits?
There is no benefit for the employee to remain on the company payroll. He would like to wrap things up with his employer asap and just focus on getting well.
