while i was roofing my moms house, the structure collapsed causing permanant impairment, the structure was constructed by homeowner with poor quality. is the homeowners insurance liable.

If your mother knew that the roof was defective, she could be liable. It would her policy that you would file a claim against. Unless she is renting... you don't mention that but I'm not sure what is meant by "constructed by home owner"... is that not your mother?

Yes, going that way & assuming she is a renter, if the poor quality of the structure was not known to her then its obvious that the landlord has to take the responsibility. Also, weighing upon the measurement of risks associated with such structural collapses I feel that the compensation ought to be huge!

Well,my first question is if its a rental ,did the landlord give permission for you to be on that roof?If your mother owned the house then it is her that constructd the roof?Sounds like a home owners policy who should pay .

makes no sense, makes no sense makes NO SENSE!

OK, I feel alittle better....something else you need to consider (cause the adjuster is gonna ask) was mom paying you? You'll open up a whole new can a worms if she was....also for sure her medpay will pay..(assuming she has it)...no negligence, liablity etc will need to apply and really only exculsion would be if you are a memeber of THAT household..so a little (probably damn little) money there for your med bills...

File the claim under mom's homeowners, there will be a pretty deep investigation re: what you were doing there (paid or not), and reason for collapse....Please keep us updated...this is a very interesting claim..

Sorry about your accident, and glad you can atleast type...gosh...oh mighty that must've been scary, for poor mom too! What are your injuries and are you alright now?
