Thanks in advance for anything you can offer that will help me. six months ago I was involved in a terrible auto accident that I very well should have died in. My Ford Excursion rolled 4 times and I was then thrown (when the locked door opened) 40' which I sustained a broken back and right/left shattered arms/wrists/hands. Needless to say, it's been a difficult time and to top it off, my husband asked for a divorce one week prior to my accident and even though I almost died, still wanted it when I can home from hospital. And to top that, while I was in hospital recovering, he took it upon to deal with insurance on the settlement of my (paid off truck). Little did I know, he's take the $27,000 check and "steal it" .
Here's my question: The day of accident, my truck was filled with items I was taking to a pawn shop and a consignment store as I needed to make some money to hire an attornery. There were pieces of furniture, upscale clothing and jewelry, IPod, DS Game systems (my kids) and a lot of other items that were either damaged or missing all together. I filed a Homeowners claim and the amount came to $10,000. For reasons I don't know, my claim is being dragggged thru the mud. I've supplied all original receipts and documention they requested and then told me I needed to go for an EUO with their attorneys and demanded crazy amounts of back-up (bank account reports, pay checks, credit reports). First: my husband is refusing to participate WITH THE INVESTIGATION.. What's going to happen to my claim if he doesn't cooperate? Second: Why is this happening? We've had this insurnace com. (one of most popular) for 20 years and only claim was minimal cost for lightening strike damage. Other than the loss of my truck 6 months ago, that's it. I can't figure it out. The man im now dealing with is very rude and he almost has an accussing tone to his voice. I had about 100 CD's and 100 DVD's in a binder that never left my vehicle and he told me that's VERY UNUSUAL for one person to have 100 CD's or DVD's in their car even though there were digital pictures taken after the accident and CD's and DVD's are thrown everywhere. You can see the binder itself in the pics also. Should I go to the EUO alone? I doubt I'll find an attorney as the claim is only $10,000.
DO YOU BELIEVE MY CLAIM WILL BE DENIED IN THE LONG RUN ANYWAY?
SHOULD I GO ALONE AS MY HUSBAND IS REFUSING TO GO? WHAT CAN I ANTICIPATE?

It is really a hard thing for me to suggest exact solution of your problem, but i think a attorney will be helpful for you as he can understand the laws and can guide you in better ways.

Whenever any insurance co. smells fraud they forward the claim for investigation. It is a long drawn process and you'll have to hold on to your patience.
