state farm witholding payment on claim

May 30, 2012 had a burglary. lost $51, 762. Some thing not replaceable.
State Farm sent a fraud investigator, who all but accused me of fraud.
After a month and a half I was informed they would only pay
$4400.00. Less than 10%. Today is July 27, 2012 and still have not received payment. Have called three times and was told that the check was mailed out on July 13th.
I talked to my attorney and he said that there is nothing you can do. It's in the small print on your policy. He said to read my policy. I told him I had never received a policy in twelve years. I went to my agent for a copy of my policy
and was told that I receive a new policy everytime I re up. The rub here is that if I
could prove that they never sent me a policy my $51000.00 claim would look like chump change. It has to do with doing business in bad faith and
breach of contract. Maybe this will help someone in the future.

Let me see if I have this correct.... you were paying for a policy, never received a copy of it and never bothered to ask? If it had been such an issue, why did not you not ask for a copy? It was there for the asking if you wanted to take a look at it. Because you chose never to read the policy did not change what it stated or the coverage you were paying for. It's only now that you don't like the terms of the contract that you raise this issue. That does not really hold any weight.

What breach of contract? Where in your policy does it state the insurance (and only the insurance company) will guarantee that you obtain a copy of the policy?

So why the 10% discount? You never mention this.

Have you asked your to what address the check was sent to and/or to place a stop payment on it and reissue?

I think you misread that. He was saying he received a check for "less than 10%" of his original claim amount.
