Charles Keith Phillips, 44, of Hurricane, has pleaded guilty to one felony count of insurance fraud for his involvement in disposing of his wife's minivan by pushing it over a hill on Poplar Fork Road in January 2007, state Insurance Commissioner Jane Cline said.
Phillips' plea agreement includes making $15,602 restitution to Nationwide Insurance Co. When sentenced, he faces one to 10 years in a state penitentiary and a fine of up to $10,000, Cline's office said.
Cline said that in November, three people were arrested for allegedly perpetrating the insurance fraud - Phillips; his wife, Diana K. Phillips, 52, also of Hurricane; and James T. Willis, 39, of St. Albans. All three were charged with one felony count of conspiracy to commit insurance fraud and one misdemeanor charge of witness intimidation, Cline's office said.
In addition, Charles Keith Phillips was charged with one felony count of conspiracy to commit malicious wounding and Willis was charged with obtaining a controlled substance under false pretenses.
Willis pleaded guilty to one felony count of insurance fraud on Jan. 3 and was awaiting sentencing when he died in late January, Cline's office said. The charges against Diana Phillips were dropped as a result of the guilty plea by her husband, Cline's office said.
Goes to prove you will almost always get caught. I'd hate to be the one paying that much restitution for such a silly act!

Wow It never seems to amaze me what people will do these days. I see alot of insurance fraud around my area. People burning there houses, paying people to fall off their roof and split the proceeds. That is why honest people pay more for insurance. This whole market has gotten out of control. I don't know what is worse the insurance claims or social security. I won't even be able to get full benefits when I reach retirement age, if I reach it at all with the age continually increasing. All these people faking disabilities to get it so they don't have to work. This all comes down to lazy people whom I have no time for..

I agree fireyone, money makes people crazy and do crazy things, I guess it is part of our make up, some of us choose to do the right thing while others chose to take the easy road.
I could not lay around and collect disability, it would drive me insane, I have to go to work, so for people that do it that don't have a real disability I agree that I don't have much time for this crowd either. I just wonder why the system let's them get a way with it. they should look at these false claims and do something about it. It would save us all money.

I also refuse to lay around. After an auto accident I begged my doc to let me return to work. She did but it isn't working out as well as I wanted. I am still going because I refuse to be a victim of the remote control for the TV. I think our goverment needs to do rechecks on Social security people every few years. The ones who claim to be disabled. They should also take the reports fro their own gov. approved docs.
