My mom passed away and she has a insurance policy, she left my dad the beneficiary and he is deceased. I would like to know does my dad son get any of the life insurance money.

Hello, ANONYMOUSME. Do you know if your mom had a Will/Life Insurance, etc? That kind of thing? If she does have a Will, it should who gets what (estate, etc.). If she doesn't have anything like that, I don't know if 'everything' would automatically go to your father or not. I'm sure one of the experts, on the Forum, will answer you soon.

Most likely, they were married right? Did they have all their property in both names? (ie cars, homes etc.)

So, LORI..in a case like this, would everything automatically go to the spouse? I would think, even if there WAS a spouse involved, everything (money, estate, etc) would still have to be specified in the Will/Life Insurance.

If there is no will, then I'd think so...remember life ins. is different, there is a named beneficary, and the money goes to that beneficary

No need to scream at anyone. You do not indicate when this all happened.

Is it recent or years ago? When did "mom" die? Did "grandmother" die prior to "mom"? Is "dad" still alive? Was dad alive at the time mom died?

If grandmother died before mom, and dad was the contingent beneficiary and still living, he would have been entitled to the policy proceeds -- no one else. What he did/does with the money is his own business.

If you are not the owner of the policy, you are unlikely to be able to get a copy of the policy without some sort of court order.

My mom is not going to make it through this weekend. Rare brain disorder. I took care of her her whole life then about 10 months ago there was a family dispute between my sister and I and I moved out of my mom's and my sister moved in to take care of her. what type of lawyer do i contact to make sure my mom's assets are divided equally between my sister and I. I know this sounds horrible, but I know the person my sister is and did all this to get my mom's money. I don't really care about the money but my husband says why should your sister get everything, she doesnt even like your mom.....confused from Maryland
