My home burned down november 20, 2009. My husband and I were on a free vacation, that we had to take then, or lose the whole trip. We have cooperated fully with insurance company. I gave them all of the phone records, tax records and our vacation records that they asked for. We sat for an EUO on March 30, 2010. We still havent heard anything from them. The only reason they are harrassing us, is because of my past. I have 2 previous fires in the past 10 years and a home burglary. My husband is an exmarine and this was his first home. I told the insurance investigator, what happened each previous time and that I was not at fault on any of it. As I told them, I may be the most unlucky person alive, but I am not an arsonist. (I have been raped twice, beaten and strangled near to death, robbed at gun point, my 2 oldest children were kidnapped by my exhusband and my third child died.) I am pregnant now and was so at the time of the fire. This has caused me extreme stress and the doctor has had to put me on shots to keep the baby from coming early. I have contacted the Alabama Department of insurance, but have not heard back from them. We have even told our EUO lawyer, to just tell them to replace the house, so my baby will have a home. They dont even have to worry about my personal property. Still nothing. Also, forgot to mention, at the time of the fire, we had about $5000 a month coming in, with only $1200 a month in bills, so they can see we had no financial motive. I dont know what else to do. I feel like they are about to just deny it, since they are doing all of this. Should I go ahead and get a trial lawyer and just take them on to court? What should I do?

I still think we should have been notified that this was an issue and they were working on it.
If you have a lease (or even not), there is likely some local ordinance, or law requiring the landlord to give you thirty days written notice..Now the expense company has to find a new house and we have to pack up and change homes again.
'expense company'? who is that and who do they work for your carrier? so they have been paying your rent all this time?The funny thing is my insurance company is one of the most reputable insurance companies, if not thee most reputable insurance company.
Bet they have a 'farm' and a 'state' in their name huh? :wink:It has just been a slap in the face since week one.

Yeah, for obvious reasons I am not going to answer that. I do have a question. If God forbid, we do get denied and have to sue our insurance company what do we do in the meantime, what happens to us? Does the lender get paid still? Does our mortgage contract change?

No, if you are denied, you're denied, and they won't pay anything to you or your mortgage company. And no, this will not affect your contract with your mortgage company.
One of the things I really don't understand though, (among others, this claim is frankly a mess :roll: ). Who is paying this rent? Did you have to sign something that said, if they ultimately deny the claim that you have to pay this back as well? You have on your HO policy a coverage called ALE (additional living expenses), but there is a limit on this coverage, and I honestly don't understand how they are paying this, and then can or will deny the claim(?). Would you enlighten us on this part of your claim..how did this come about and what 'agreement' was there between you and your carrier regarding this?
