homeowners or liability or what

If my kid is playing at a neighbor's house and accidentally damages their very expensive rug, would my homeowners liability insurance typically pay? Or would their insurance? How does that work? Thanks in advance.

If your son was liable, then your HO policy would provide you (liability) coverage for the damage.

When you are liable for the damages caused, your homeowner policy should ideally pay. However, if the neighbor decides to file the claim under their policy then their HO insurance would provide the coverage, but later on will subrogate your insurer to collect the damages.

Hi, I think that you should solicit to pay for the damages and turn the claim to your carrier. This way, you would still be at the talking term with the neighbor and your kids may continue to visit their place to play.

Thats a good point but I am sure if the neighbors have kids of their own surley they would understand how something like this could happen. Just sit down with your neighbor and discuss what options there are and come to an agreement on what route you both would like to go. It shows that you are both responsible adults and will also set a good example for the children.

Homeowners insurance provides personal liability coverage too…

In addition to property coverage, the HO2 and HO3 homeowners package policies include personal liability protection and coverage for medical payments to others.

Liability coverage protects you when you, other members of your household, or your pets are legally responsible for injury to others or damage to their property. If necessary, liability coverage will also pay for a lawyer to defend you.

Before filing a claim, see how much the repair to the rug will cost.

You may not want to file a claim.

Sometimes that is the wiser thing to do. Keeps the claims off your policy..

Hi, thanks for the input everyone. So the liability portion of my insurance should cover it. Does the neighbor have to sue me or something for that to kick in or can I just file a claim as I normally might? (I'll also keep in mind that it might not be in my best interest to file a claim).

Ideally you would file the claim but do check on your deductable first and also be aware that a claim could increase future cost of protection.
