Ummm... this makes no sense at all. How can you be placed on probation for a crime without first being convicted of that crime?
As far as I know, that isn't possible. What are we missing here????

I think she means without having spent time in prison. Probation in lieu of time in the Big House. Obviously, probation follows conviction.
It's not one of the federal disqualifiers under 18 U.S.C. 1033, but it could still be a problem under state law.

Max,
I dunno about that one NOT being under 18 USC 1033. I might be wrong, but I think 1033 includes "convictions of any felony involving dishonesty or breach of trust." Don't have a clue whether this would be thought of as a breach of trust, however.

The breach of trust issues raised in 1033 are, to the best of my knowledge, fiduciary and money/property crimes, not child custody issues.
But, as we both know, the states take a dim view of felony convictions anyway. In CA, for example, any felony conviction (in practice, within 5 years of application for a license) can be grounds for a summary denial of the application -- no right of appeal and a five year ban on new license applications.
