FELONY CHARGE

I PLEAD GUILTY TO A FELONY CHARGE FOR MISSING TRUST FUNDS FROM OUR INSURANCE PREMIUM ACCOUNT IN 2007...I HAVE RECENTLY REAPPLIED FOR MY LICENSE AND NYS IS GIVING ME A HARD TIME EVEN THOUGH I HAVE MET ALL THEIR REQUIREMENTS INCLUDING A CERTIFICATE OF RELIEF FROM DISABILITIES FROM THE COURTS...I AM NOT SURE HOW TO PROCEED...ALL PREMIUMS WERE PAID BACK AT TIMEOF SENTENCING...HELP ? CAN I BE LICENSED IN ANOTHER STATE ? AND IF SO WHICH STATE.

Your crime is a "fiduciary" offense, and will likely prevent you from being licensed in any state. This is not an industry that takes kindly to persons who commit offenses against other people's money, since that's what you would be dealing with on a daily basis as a licensed agent. Sorry . . . look for some other career path that does not put you in contact with other people's money.

Almost any felony involving moral turpitude prohibits the offender from obtaining an insurance license in any U.S. state. Doesn’t matter how long ago the felony was committed.

The statement above is fundamentally correct, except that the law permits each state's insurance regulator the privilege of granting a "waiver" of the prohibition. A variety of mitigating factors in favor of the applicant may persuade the regulator that the individual is worthy of being licensed. But the decision of the regulator is not appealable if adverse to the applicant.
