Disparity Between Exams

Is it strange for one company (USAA - former service) to ask you to list every doctor you ever visited and a long list of questions about past habits et cetera and to give you a very thorough exam and another company (Mutual) to barely ask any for the same amount of coverage (500K). Obviously I don't mind but I want to make sure nothing is being misrepresented or omitted that would cause the claim to not be paid down the road - but the examiner blew off my asthma and barely asked anything else.

I am 38 good health, minor drug use waaaaay back but nothing on record.

Ask the agent to put that in writing on company letterhead. You cannot rely on the words of the agent, you have only the words in the contract. If answers were changed on the application compared to what is accurate, that is definitely something that needs to be reported to the insurance company BEFORE a policy is issued.

You should call the insurance company's customer service number and speak to someone in the UNDERWRITING DEPT to make sure your application reflects the most accurate information. Once the policy is issued, essentially, you are stuck with the answers that are in the application.

If the agent is willing to write a letter that confirms he gave inaccurate information to the insurance company, that would be prima facie evidence that could obligate the insurance company to pay a death claim, under a theory of APPARENT AUTHORITY, notwithstanding other words to the contrary in the contract. Without the letter, it is just another case of he said-she said, and the jury has to consider who the better story teller is. (If the agent refuses to write the letter, then you know for sure something is not on the up and up.)
