Contesting Beneficiary of Life Insurance

To sum this up: My ex husband and I purchased a life insurance policy on both of us in 2005 (we were married). We divorced in 2011 but the life insurance premium remained drafted from my account. Within the last year we changed the payments to draft from his account. At that time we had a discussion about the beneficiary of the life insurance policies and decided to leave them as is. We have two young children and he was a big part in their life and a great father. I left him as my beneficiary. He was killed a little over a week ago in an auto accident and when I called the life insurance company I found out that he changed the beneficiary to his new wife. They were married this year 03/24/2013. They have no children. Is there any information anyone can give me or a direction on contesting? Any information is appreciated.

You have no case unless you can prove he was supposed to name you as the irrevocable beneficiary, which is highly doubtful. In the absence of such proof, it is not even worth the effort to attempt to challenge this, because the law is not on your side and you will lose.

Depending on the state in which you reside, you may have already been revoked as the beneficiary in 2011, and without being renamed the beneficiary, you lost all entitlement to the death benefit at that time under state probate law. There are now 22 or more states with such laws.

You have the right to continue your insurance coverage as a separate policy from the same insurance company, to pay the premiums, and name your children as the beneficiaries.
