I recently posted this question.

I was not very clear so I will start from the begining. My father was killed at his home during the execution of an search warrant. They say he brandished a gone and open fired. He does have an life insurance policy I am the named beneficiary. There is not a POA or a trust setup. I am 17 and will be 18 in April. The incident happened in Canton, Ohio which is were I lived till 2 months ago. I now live in Killeen, Texas. My question is will they hold the insurance money? I know I am going to get some money for his death but he was signed up for double of what I am getting but they have to Investigate and determine if I am eligible for the double amount.

Sd, surely the cops were not searching the house of the deceased just for fun, they had a distinct purpose for doing so. It may or may not be the same case that Gary is referring to, but some reason was certainly there.
However, the question remains that how the life insurance company would handle the situation. If there is this felony exclusion in the policy as the experts are saying, I'd doubt that the insurer will recognize the claim of the claimant.

JEORGE........well, when a Search Warrant was issued, I kind of figured that. I'm just saying, at the BEGINNING of the thread, a few posts, by the OP, were something like 'I'm not sure WHY this or thst happend.' Just seems like the answer the OP was giving, to OTHER people was 'beating around the bush' a bit. Aren't there 'rules' about paying out Life Insurance money? For example.......I have Life Insurance throguh the Military. If THIS was the case, about a 'drug-related' incident, in which the Soldier died, the Life Insurance is 'null and void'. Do you get my question?

First the op said it happened in april not sept...so i don't know if it's the same...i thought it said something about a search warrant being served and the op's father supposedly pulled a gun and/or fired and the cops shot and killed him...i really doubt this is made up, i think the op would be spending a lot more time in the thread, i have received a few pm's from HIM about this, i think he felt a little attacked, i don't know why we would assume that this is false, but ok, if you want to think so, you can still answer or debate the question at hand, and IMO something like this should be taken as true, and some sensativity shown for the situation.

LORI.........I can see your point. As I read the information, given by the OP, I'm just trying to figure out the 'timeline' and what happen when. Gosh..........this entire situation must be SOOO upsetting to the OP. I guess if I felt like someone was 'judging' me/attacking me, I probably wouldn't be posting for awhile, either.

OP shouldn't feel attacked just because his story is being challenged. This IS the INTERNET where the most preposterous twisted half truths and outright fabrications exist.
Now I'm sorry, but the best information on how that claim would be paid would come from ING itself the insurance company. A 17 year old male who was the sole beneficiary would have been on the phone within days of the death to find out exactly when he would get the money and how much.
The nature of the death certainly would have been communicated to the claims department. If the shooting by the police is ruled justified then no double indemnity. If the police raided the house, bashed down the door and the guy turned toward the door with the remote control in his hand that the cops mistakenly thought was a gun and shot him to death, THAT'S AN ACCIDENT.
So why do I challenge the veracity of these stories?
Simply because they violate human nature and I have 24 years of insurance experience and have paid many, many, many death claims. What I outlined above would have been told to the beneficiary on day one. Maybe it's just me, but the opinions of a collection of anonymous posters on an Internet Message Board has no effect on how that claim would be paid and more than likely, as we can read in this thread, would be contradictory.
Personally, I feel if someone wants the luxury of posting anonymously they should expect to be challenged if their story sounds like a story.

Ok..GARY. You SURE made your point. :D Something you said, GARY, makes me think. Why DIN'T she call the Insurance co ASAP? But...I'm sure there was SOOO much going on, she din't think of it. What to do about...this or that. Also...you are right. The Insurance will be given...reguardless of what WE say. I'm just trying to 'follow' was was/is being posted.

Ok, then that's it, if the fellow had actually brandished his weapon to the cops and had got shot by them in the action, then the beneficiary isn't entitled to receive the accidental death benefit. However, he will still receive the normal death benefits from the policy. The boy, however, will get even the double benefit if it was just a freak accident and the cops had killed his father by mistake, which wasn't the case according to his own words. Hence, he is out of luck in this case I suppose.

That's how I was reading it ( somewhat), SIMON. I mean, if the father was the 'cause' ( brought this all on himself..kind of thing.) The police wouldn't be there in the first place, if something wasn't going on with the father. My point of view..anyway.

I'm not getting where you think he waited on that? he did, and knows he will get the policy's death benefit, his question was when since he isn't an 'adult' till april, and also they are investigating the double indem. portion...or do you mean that he would be asking them 'when' am i getting the money?

I'm sure he's pretty 'raw' right now, and who wouldn't be? I doubt the story is made up gary, otherwise he'd be here 'playing' alot more...and i agree there are plenty of made up storys etc...(ie 'getreal') but I've known and raised 17yr olds, and don't think this one is making up anything, nor do i think we should automatically assume something that is 'large' is crap, unless we have good reason to think so, this is more than likely a personal/personality thing, (although i'm very suspicious by nature, likely the job)...still i think 'true' unless proven 'not true'..and when human compassion is worthy of any situation, 'I' think we are remiss in not providing it to a fellow human, rather than jabs...but that's me I guess...I'll eat crow too, if it turns to be false but even so, could there not be benefit to another 1-4-or ten years down the road? There are plenty of GOOD REASONS to post anonymously gary, because you chose to use your full name, does not in any way make your choice right or wrong, you've made the choice it's right for you...but you have no business telling anyone else to do the same...in fact you are probably one of maybe ten that have posted to this forum with your name and why? well you're selling stuff for one thing...i understand that if I was in sales i might too, but I think you're wrong as rain judging others that don't chose to do the same...gary, sorry i have no idea how all those other little storys have anything at all to do with this? :?I'm with you on the if it were an 'accidental' cop killing (ie remote) then there would be double indem..(and a huge settlement from the city) but doesn't sound that way at all in this case, again, I'm having trouble getting my head around the accidental death thing...(as an adjuster and how i would handle it) there are so many good arguments to be made on both sides, and unfortunately the ''other'' side, can only be guesses since he in no longer here.

But equally TRUE is if the SWAT team bashed down the front door and the guy turns towards them with the TV remote control in his hand, they thought was a gun, and shoot him to death the cops will cover up their crime.
If you're a poor person living in not the best of neighborhoods the police bash down your doors with Blackhawk helicopters flying above with spotlights on for a show of force for the 6:00 o'clock TV news.
If you're the corrupt criminal Governor of the State of Illinois they call you on your home phone and politely ask you to be taken into custody so they don't wake the wife and kids. That way they can book you and you'll be home for breakfast.
