Hi,
I am currently going through a divorce. We are still legally married, however I recently found out my spouse is terminally ill. Can a spouse be removed as beneficiary without being notified or without consent? The policy was issued an maintained as part of his retirement pkg. A group life ins. policy issued in 1988. Thanks for any help on this gquestion

hi there, i have a joint life insurance policy, but haven't been with my partner for over ten years. I would like to remove his name off the policy and put it solely in my name it has been me paying for it from the beginning. I now have an 8 year old son. Can i put it in his name along with mine?

Who is the "Owner" of the policy? There will only be one. If you are the owner, then you can make any changes allowed by law, including removing a named insured from a joint life policy. Adding a new insured in their place may or may not be permitted by the insurance company.
But are you really talking about making your child a joint insured or merely the beneficiary of the policy? You would not be the beneficiary on a policy in which you are the sole insured.

Most states have laws prohibiting such contracts. If you are aware of life insurance issued on your life without your consent and cooperation, complain to the state Dept of Insurance.
In some states, you may have a cause of action against a person who violates state law in this regard.

My daughter's husband is stating he is going to take my daughter off his medical insurance. They are not legally separated at this time. Can he do this ? If so what are her option? She has a pre-existing medical condition.

Unless they are legally separated, your daughter cannot take advantage of COBRA continuation. If a divorce is going to happen, then your daughter should file for a legal separation immediately, with an injunction against being terminated prior to the separation being affirmed by the court. The injunction, if granted, must be served on both her husband and his employer.

If it is individual insurance, YES. If it is group insurance, MAYBE. For group life, you have to read the SPD (Summary Plan Description). That will tell you what you need to know about changing beneficiaries.
