My husband paid on an insuranced policy every month directly from our account but before we were married he was seeing someone else and they have a child together,but he never changed the beneficiary on the policy as the wife do I have any rights?

Are you sure that it is not required that he has the policy with the previous woman / child as the beneficiary? Many child support orders also mandate that arrangements be made for the support of the child in the event of the non-custodial parent's demise.

Are you still currently married? Have you asked your husband about it? You can't force anyone to change a beneficiary. If you are going through a divorce, they may state that if he took money from you to pay the premium, that he may owe you some money. He may also be required to have an insurance policy with you as the beneficiary, but they will NOT make him change the beneficiary!

The best thing to do is talk to your husband and find out a little more about it. My thought would be he is required to have it. Does he also pay child support? Even if it isn't court ordered, maybe there is a prior arrangement between him and his ex!

Chris has asked all the questions that I've intended to ask you. :D

Since the child is involved I think he is required to maintain the policy for the child support purpose. IMO the best way to find out more about it is by asking your husband. And, let us know what his theory is.
