I also have a last will and testament with decease stating that nothing is to go to his children leaving me and my husband as beneficiary sign by decease and notarized by 1 witness in a lawyer office.I didn't know I would have to go to court or have a problem or this kind I trusted the insurance agent.They mail me a check with estate on it that I could'nt cash.I was told he lied about putting me on as beneficiary instead estate.How do I go after this company and agent.

What's there to go after? If the beneficiary is the estate and you and your husband are heirs to the estate, all of the insurance proceeds will ultimately go to you once the estate is settled.

It would have helped if you could get in touch with the lawyer's office where it supposedly got notarized.

Providing there aren't creditors to the estate. It's also possible that one was never opened and they don't want to open one just to get the life insurance proceeds, which shouldn't have been necessary.
Agent apparently messed up, but the sad reality of this situation is your going to pay one way or the other.

"Get an attorney" ?? When the death benefit was paid to the estate it caused it to go through probate. (attorney Fees) Now if she gets an attorney, she will have to incur more attorney fees to go after the agent and insurance company of which she may not get a penny. Cut your losses pay the probate fees and move on.

If an agent was truly negligent in completing the application and/or in providing improper advice concerning the beneficiary designation(s), it could be actionable against the agent's E&O policy.
Might consider contacting InsInvestigator Mark about the merits of pressing that kind of case.
