my stepgrandfather is keeping insurance policies from me..

my grandmother died in 2001 and left me and my family insurance policies. she was married but due to the circumstances of her marriage she didnt leave her husband (my step grandfather; not blood) anything. to this day he has all of the insurance policies locked up and says no one is getting anything until he dies, even though his name isnt on anything. she left me money for college, and i am now 18 years old and ready to go to college. I live in San Diego, CA. and none of us no what company the insurance policies are from. what are my rights? what must i do to get the policies that i am entitled to?? i really need the money and he is not willing to give the policies up, even after 7 years..PLEASE HELP ME!!! THANX. --DG

my grandmother told me right before she died...that she had them for all the grandkids, including myself. and yes my step grandfather cashed his biological grandaughters policy...it was supposed to be for college but she was only 3 at the time. so of course if my grandmother TELLS me i have one, and after her death my step grandfather cashes the one for my cousin...and tells us we do have policies that we arent getting until his death...then yes of course i have at least one...my mother and brother do also.

I'm sorry sweetie I think you're gonna have to take step Grandpa to court or...honestly if it was me I'd go over there and get them, let him call the cops on me, when they got there I'd ask them to HELP ME get MY property from the old fart, and call it a day..

I'm sorry --- this might have already been covered but, was there a will? Probate? Inventory of assets for grandma? If the policies were owned by grandma they should have been in the inventory of the estate. In Texas, I believe that the policies would be community property and passed to the spouse: the step-grandpa.

No brandi life policys go to the beneficary, period...if there is no beneficary (which I've never seen, not even sure if it's possible, you could always name, 'estate of')...then it would go to the next of kin, but in no way can the spouse step into the beneficarys spot.

Lori - you are correct if we are talking about the policy being written on the deceased life but we don't know that for sure.

From what I have read in the posts, I think the policies were written on the grandchildren's lives. If this is the case, then the policies are not subject to any claim. Therefore, the policies pouring over to the spouse at death.

My question still stands ---- was there a will? probate? The policies we are going on about should have been listed in the inventory of the estate.

im sorry you misunderstood lori, i meant that there was money for my family and i on my grandmothers life. as in we were the beneficiaries

well then what are you waiting for Grant?!?! Go get what's yours. Take action. Get a lawyer. Go into step-gp's house and get those policies. This is business.

I still want my question answered - will? probate? something?

Hmmmmmmm, very interesting twist.

Grandma would have been the "Owner" and the "Beneficiary" and the Grandchildren would have been the "Insured." The policies would be Grandma's property passed on the surviving spouse.

That's a very interesting twist!

We'd have to see the contract to see if Grandpa was named as the Contingent Owner.

Can someone please guide me in the right direction? My mother's new husband keeps saying he has power of attorney over my mother and all benefits, I don't believe this is true due to previous conversations my mother and I had before. She told me she had my sisters and myself on her policy. Can he take my sister and me off the policy and leave the other two sisters on? My mother is still alive but in out with dementia. Please help me.
