It's commonly referred to as No pay, No play.
In LA this only applies to non-economic losses (i.e. pain and suffering as a result of an injury). It does not apply to property damage to medical bills incurred as a result of an injury.
Question... how would you feel if someone totaled out your vehicle and did not have insurance? What would you do next? This is a rhetorical question... just trying to put things into perspective.

They are right. This is called the no-pay-no-play law, under which if you don't carry liability coverage the Louisiana law would prohibit you from collecting the first $10k of damage.
However, I've a question, how can you have gap policy without having proper insurance? Do you have collision coverage?
