Is this fraud?

I am a board member (treasurer) of a condo association. We had a substantial insurance from roof damage that included damage to the interior flooring of 4 condo units. I found out that an owner submitted an invoice to our prop. manager to get reimbursed for the repairs in his condo and did not actually have the work done. is this fraud? Our insurance carrier sent the check to the association with a dollar amount allotted for each of the 4 condo units affected by the damage.

not technically as far as I'm aware. the insurance claim was settled to the owner and it's up to him to do the work if he wants. If however he has an obligation to maintain the appearance of his property under a separate agreement (as ugly properties can affect the value of other properties nearby) then you could persue this with him.

also, if he fails to carry out the repairs and someone elses property is damaged as a results (due to water leakage etc) then he could face liability for damage to their property.

If the owner of the condo recieved the check, then yes it would be considered fraud.
