There was a storm with wind and hail. My roof was visually damaged on the back and not in the front, but it is leaking through the ceiling in the front of the house. State Farm Insurance Company says they will pay for 1/3 of the back of the roof and the ceiling inside the front room because there is no "visual damage" to the front of the roof. I do not understand because if they do not replace the front of the roof, it will just leak again! I am a single female and an extremely honest person. I have never tried or would never try to take advantage of the insurance company. but all my married neighbors are getting full new roofs, siding, gutters etc and I cant even get them to pay for a roof. I think I AM being takin advantage of and I think it is completely ridiculous. The first adjuster came out and I did not have a roofer to meet him-he was a total jerk. So, I had another adjuster come who was a very nice kid, but said State Farm will not replace it if it is not visible????? The roofer thought it was crazy too. I have had several roofers come and I have told them to just give me their HONEST opinion and they all say I am being screwed. Now, I do not know what to do? Any suggestions? Just get screwed because I am a nice person that isn't throwing a fit?

My recommendation is to evoke the appraisal clause. Obtain your policy and review it to see how this works. You should be able to use one of those roofing companies as your appraiser.

just get one of the roofing companies back you with proper reasons why the front of the roof also needs replacement, and support your claims as valid.

A Residential roofer would have to General Liability Coverage. This prtctoes you from Damages do to his negligence from Bodily injury and property damage.If the roofer fails to properly Tarp and protect the roof (during construction) during inclement weather and water comes in and damages you insulation and Drywall then you would have a claim against his Liability coverage. If His ladder falls over and dents your car then this is a claim under his Liability. If he injuries someone (ie: roofing material falls off the roof and hits you on the head. Then this is a liability claim.As a Sole proprietor. It is not necessary to have Workers comp however, it is advisable to have a contract agreeing that you are held harmless for any injury that would happen during the project. He ould have a written estimate to you and on this would be a payment plan. I would not pay more than 1/2 of the Bid up front and pay the other half only after you have inspected his work and it satisfactory. DON'T pay in full until YOU are satisfied.Get a certificate of insurance from him showing a current policy with at least $300,000 of liability per occurrence.I would also recommend getting referrals from him of other homes he has done and call those people on his workmanship.
