we made a claim after a hail storm and after the adjuster came and subbmitted the claim we got a call and said don't cash the check as we are stopping it . They said "it appreas that we did not repair the roof in 2004"
We have been told by someone working for a local contracting company that have previously been adjusters that once a check is issued they can not take it back? We paid for coverage and were never told that it was not covered for the past 8+ years. Can they not pay the claim and charge us all those premiums as that is double payment on our part. What can we do????

The insurance company has put you on notice that they have/will place a stop payment on the check. So if you attempt to cash it, knowing it's not good, then the results (a returned check fee on your account) will be on you. If you cash it, your bank will accept the check and it will eventually be presented against the bank it was drawn on. It will have a stop payment request on it so that bank will return it to your. Your bank may then charge you a fee.

A check is issue and accepted in good faith. If someone had not told you not to cash it, then you'd have every right to expect it to be good. Again, now that you'd been told a stop payment was placed on the check, you will be responsible for any fees assessed against you.

What your insurance company is saying is that you collected twice on the same damage. Feel free to press this issue if you would like. I don't know that you'd come out favorably.
