Damage- neighbors irrigation leak. My insurance or his ?

neighbor's irrigation broke and flooded my basement.

I could claim against his insurance, or my own insurance which would "subrogate" claim against his insurance. damage is about $2500 to clean up. my deductible is $2500. It is unknown whether claiming against my home insurance policy will result in a rate increase. any feedback ?

If I claim against my neighbor's insurance, they will try to lay the blame on the landscaping company that maintains the irrigation system. So the question of who's liable is still in discovery.

If this is true, you have no reason to file a claim with your insurance company. If your neighbor was negligent, his insurance will pay your full cost of repair/remediation. If the landscaping company was negligent, their insurance will pay.

Leave your insurance company out of it. Because the water came from outside your building, it would probably be considered "flood" damage and not be covered.

It's your neighbors irrigation system, not the landscapers. If the the landscaper is liable then the neighbors carrier can feel free to go after them after they pay your claim. Your complaint is against the neighbor.

Ok, I filed against neighbors insurance - Farmers.

So far, it appears that they are going to take their merry time resolving this pretty straight forward case.

How long should I wait before I get my attorney involved ?
