How long before I give case to my attorney

neighbors irrigation broke - flooded my crawlspace under my
house.

I filed claim against neighbors insurance - Farmers. So far it's been painfully slow to see any progress.

How long do I give the insurance company before I hand this case over to my attorney ?

As long as you want. Be prepared to either pay a percentage of your loss amount to the attorney or an hourly fee. The other party does not owe for this fee so you will get far less then the cost to repair the damage.

Have you called Farmers and asked them what the delay is and when it will be resolved? If they don't give an answer within 24 hours, call that person's supervisor. If you don't hear anything within 24 hours after that, file a complaint with your states Dept. of Insurance.

An attorney will not take this case on a contingency, if even willing to take it at all. You're talking about $5000 in damage -- below the maximum limit in most states' Small Claims Court.

If you have to pay an attorney $5000 to get you a $5000 settlement, you have no more in your pocket with an attorney's assistance than you have today while you wait for the property owner's insurance company to write you a check.

If you want action, then simply file a lawsuit on your own in Small Claims Court. You sue the property owner, and probably also need to sue the landscape maintenance company, just in case they bear liability for your loss in some what. The judge will sort all that out for you. Once the judgment is rendered, you can press your claim with the offender's insurance company and a check will be written.
