1. This policy was in effect until 11/1/2012. I have since replaced it and no longer have State farm Ins.
2. I put in a claim to State Farm because the root damage from my neighbors tree occurred over a long period of time during which I was covered by State Farm.
3. I just discovered the true reason for the damage that has been occurring to my home by taking a chunk out the patio. A root as big as my arm was looking back at me. Neighbors pine tree is the only tree around within a 100 ft or more.
4. I have owned this property for twenty years(State Farm insured me all that time until 11/1/2012), never had a problem like this until a tree contractor pruned their tree to the "nub" about 28 months ago putting the tree in survival mode to get back what they cut off. No warning from anyone. about what to expect from the root system.
5. I feel that 95% of the damage occurred while I was insured by State Farm.
6. The damage is being caused by a "nuisance", however if I poison the roots or hurt or kill this tree I can be liable for the damages to it.
7. April 11th 2013 was the discovery date of the nuisance. I have told my neighbors about it. They said a tree expert was coming out last Thurs. to advise me. I have not heard from anyone about the root problem, except for a free consultation from a local attorney.
8. I live on the side of a hill and thought the damage was occurring due to earth movement caused by gravity and the rainy season. I didn't think there was any coverage for that, thus no claim.
9. I am a disabled senior citizen with limited financial resources, and have asked my neighbors to help me resolve this situation. They have not even been interested enough to come over and see what's happening.
10. I am lost as to what to do, but have informed the State Farm agent I bought my policies from what was happening. The claims person there said she would put the claim in, but said she had doubts the damage would be covered as I no longer had a current policy by them. She will be sending in the claim though to the main office.
11. After reading my policy, I am confused of the coverage. I have seen in Case law that I should be covered, but am uncertain. Please help.

We can't read your policy nor can we know for sure how state laws apply. My recommendation is that you simply wait the week or two weeks until State Farms lets you know if it's covered. You can then go from there.
