INSURANCE CLAIM WHILE SELLING THE HOUSE?

PLEASE HELP!!! I own a house outright. There is no mortgage lender on the property. We are in the process of selling it but while it was vacant, someone broke in and vandalized the property and stole everything - kitchen cabinets, bathroom cabinets, countertops, flooring, interior doors, windows - EVERYTHING! I am selling the property "as is" and am selling it at a reduced cost because of the damage. Can I still file an insurance claim while I am in the process of selling the house? Is it okay not to use the insurance money to fix it up? Will I get myself into legal trouble? What if the property is sold before the claim is closed? PLEASE HELP!!

You can file a claim. The insurance company my require you to file a police report and my want to inspect the damage. They may exclude coverage if no one was living in the home. If you have Replacement Cost Coverage they may may Actual Cash Value (apply depreciation) and if you don't have things repaired you won't be paid the difference. You can take the money and do whatever you want with it.

Agree with TCOPE but I will add that "They WILL require a police report and they WILL inspect it". Depending on the circumstances they may also involve SIU (Special Investigation Unit) to check into to rule out any fraud occurring.

Before filing I would familiarize yourself with your policy. Many policies will have language relating to the property being 'Vacant' or 'Unoccupied' when there is a claim for Vandalism. It limits their liability.

This is a two-day demolition job for a crew of five or six. If the property is in a residential area, my question is: How did this go unnoticed by neighbors?

Sounds mighty suspicious to me.
