is it legal to add a person to the ck if they are not on the policy?

If it's a first party claim they should make it payable to the policy holder.

I am the only one on the policy and there is no third party involved they have never spoke to me re: my claim or policy period and they have always talked to my husband which I don't feel is right. Am I wrong?

I see nothing wrong with speaking to your husband... you are married. Your stuff is his stuff. However, I don't see why they would out his name on the check.
If this happened, have him sign it or call the adjuster and find out why they put his name on the check.

they would not take his name off , also the adjuster would never return calls he finally met me in a parking lot to get some receipts also me and my husband were seperated and they still put his name on the claim check. My question is this legal? without a policy holders o.k.

If they would not take his name off I'm guessing you asked them about this. Why did they tell you that they would not tale his name off? I'm thinking you might be leaving something out... such as the property damaged was his property as well.
If you think this was done incorrectly than I'd recommend you file a complaint with your states Dept of Insurance.

before we married he got rid of what he had because I already had everything and Im not saying he didnt deserve some to rebuy what he did lose I just want to know how is this legal
