Defamation of Character

On December 6th of 2008 I had items stolen from my house. Three off these items were laptops. When my adjuster had my taped conversation with me in regards to my claim I stated to him that I own my own business and sometimes I work from home and I use my computers for work. Now please bear with me because this is the important part.

"I made the statement sometimes I work from home."

At no time what so ever did I say I operate my business from home. I am licensed with my state and were I operate my business from And it is not the address were my insurance claim was filed at. However a week after I spoke with my adjuster I received a letter from my insurance company that says my insurance is being dropped because I operate my business from my home.

At first I thought hey I knew they were going to be looking for a reason to attack every part of my claim because no one wants to hand out money. But then it really started to stick with me based on conversation with my adjuster.

Is there not a database somewhere where this information is going to and will that not cause a problem for me with insurance in the future? I checked wikipedia for the definition of defamation and it most definitely is. To me it is no longer about the claim per say but the fact that the company that was representing me in my insurance claim has misrepresented me in making the statement I operate my business from my home. Does anyone have any thoughts or ideas on how I might want to handle this?

Yes, first... your not even close with defamation of character (the only information that would be released about you is that they chose not to renew your policy).

Second, have you called your insurance agent and discussed this situation with him/her? Its possible for anyone to make a mistake. Its also possible for them to correct their mistakes.

Tscope is on the irght track here. I would call and ask them why they came to their decision and inform them of what you have posted about "sometimes I work from home". If it was a recorded conversation then you would have no trouble proving this was your statement. Maybe it was an honest mistake and could be cleared up fairly easily.
