My brother passed away unexpectedly this past week (God rest his soul) and I am the beneficiary for for his policy. He recently updated his policy within the past 3 months and I have always been the beneficiary on this policy. He has two kids (17 & 15). I am worried that his ex-wife will be coming after me for control over what is left over on the policy after burial cost. His wishes were for me to take care of his children by setting up a trust fund for each without letting his ex-wife have any control. Does she have any rights to any of the funds? Can she dispute the beneficiary? If trusts are set up, does she have any say so how it is spent or given to his children?

No, I don't think she can do anything that she wishes. If your brother had intended you to look after everything and listed you as the "named beneficiary", then it's not possible for her to change anything now.

If the trust is set up in a way so that the ex spouse will have no control, then I see no reason for the policy holder to be scared. She will only have access if she's the trustee. So, there has to be a will guiding the trust - a revocable trust.
