Two types are available… one is contributory negligence law and the other is comparative negligence law. Contributory negligence law comes into play to defend the at fault party when the party negligently harms another while the injured party himself was negligent in the slightest degree.
This defensive law is often used by employers in suits brought by injured workers.

By the comparative negligence law, damages are generally set in proportion to the degree of negligence credited to all the parties. And this settlement issue of responsibility associated to the individual party is to be resolved in the court.

Most of the states follow the comparative negligence standard. This negligence law is related to the worker's compensation liability insurance. And my knowledge says that most of the states follow the comparative negligence standard.

Comparative negligence law is applicable to determine the responsibilities and damages based on the each party involved in the accident. But the cases are not so simple to figure out the negligence level as the damages are problematic and subjective. Some states having comparative negligence and some having the contributory negligence law which denies the recovery to any of the party in the face of accident.
