I agree with tcope. Isn't it obvious that your the insurer's won't pay if the respective insured aren't at fault?

I don’t know the specifics of Missouri law but there is a small but growing movement to disallow an uninsured motorist from recovering economic damages even if they bore no fault in the collision. It’s premised upon principles of equity and contract (i.e. the license compact with the state). Essentially, by choosing to place his or her uninsured vehicle on the roadway the operator of that uninsured vehicle commits an “ultra vires” act (i.e. an act not authorized by state). Had they complied with the law and kept their uninsured vehicle off the roadway, the collision would never have occurred. Equitable principles do not allow a person to profit from their own wrongdoing.

Does not apply in MO. Also, the No Play/No Play law changes from state to state. LA now states you can only collect up to $25,000 if no insurance (I'm pretty sure that is right).
