Double dipping laws in North Carolina

I just happened to stumble across the fact that my chiropractor should have refunded me the $1020 that he was overpaid by the insurance companies from my no fault accident in 2007. I questioned them about it and they said I "cashed it in early May, 2007" but haven't shown any proof except for sending me a copy of the front of the check. She even told me I was overpaid $400 I think in an effort to scare me into backing off. So, I actually took the copy of the check to their bank, explained the situation, and was told from what they could see, it hadn't been cashed and I should ask for a copy of the back. I haven't called and requested that yet but does anybody have any advice to where I should go from here or what the laws are in North Carolina? I don't really know where to start looking. Thanks!

What possible difference could this make? If they were over paid then they simply write you a check from their account...This has to be the stupidest comment regarding overpayment I've ever heard! :shock:

Well first who issued the draft/check your auto or health or the other at fault partys insurance company?

I'd start by telling the Chiro that if we cannot clear this up between ourselves I am first calling the issuing ins company and having them stop pay on the draft, if it hasn't been deposited, advising them what is going on then my next call will be to the state dept of insurance to file a formal complaint. Explain that you are a reasonable person and if you don't have the entire amount coming that's fine you just need to see the payment vs charge records for this to determine what you are owed. Fyi, you can get them from your insurance company as well....Then make good on your statement if the chiro will not pay you what is owed called the carrier (who can also tell you if the draft has cleared or not) then file a complaint..All states have web sites for their dept of insurance all I've seen also have on line complaint forms as well as consumer advocates. I'd be willing to bet the chiro will decide they want to pay you back what you have coming.

Hi Lori, when are where is the right place to file a complaint against the chiro? Do I've to complain at the department of insurance?If the chiro is overpaid would the money then go to the insurance company or that would remain with the claimant?

That's a good question and the answer is it depends...if the state allows double dipping of medpay and all subrogation claims have been satisfied (ie health carrier) then the overpayment would go to the insured (one with medpay)...

I would file a complaint with both the dept of insurance and the governing body of the chiropractor..this is nothing short of theft (IMO)
