If a married man does not file for Legal Separation when he chooses to leave his wife, is he still Liable for her debt(s)?

If you are not separated legally, which means you're still married, then 'yes' the spouse is responsible for the debts accumulated by the other partner. This would apply to you as well. Therefore, if you are not together anymore ask an attorney to draw-up a legal separation document. Except few states, like-Delaware, Georgia, Mississippi, Texas and Florida , all other states would recognize the legal separation document.

Diana, please provide us the following information.....it'd help us to apprehend the situation better.


  • Your state of residence.
  • Type of debt, such as- credit card, secured debt, mortgage and like.
  • Whether or not these debts were acquired after marriage, and/or jointly hold.


But, yeah, since you are not legally separated then most likely he would still be responsible for the debts.
