My father-in-law died from injuries sustained in an auto accident over two years ago.
He named four beneficiares on an accidental death policy worth $20,000 to be split equally:
1. His second wife
2. Oldest daughter
3. Middle daughter
4.Youngest daughter
The second wife and oldest daughter(my wife) have signed the proper form.
However, the two younger sisters hate the second wife so much that they do not want to sign. We have been told that if the sisters don't sign by December 6, 2009 that the money will go into probate.
Since my wife signed is there any way SHE can still get her $5,000.00 without doing anything legally?
My wife is on speaking terms with the second wife. But we doubt this widow would share any of the money with her.

For Pete's sake...They'll just cut off their noses (and your wifes) to save their faces won't they...geeze....Do they understand that by doing this, there will be fees that have to be paid? maybe that's their point to reduce this pay out to nearly nothing...Since my wife signed is there any way SHE can still get her $5,000.00 without doing anything legally?
Not before the other two either sign, or the judge does after probate...I would certainly make it clear to the Judge, that I had nothing to do with this, and maybe your wife and the widow will not be held responsible for any of the probate costs..only the sisters that are stiring up this mess. Do the sisters understand that more than likely that it's still going to come out the same? That this will be for nothing? I guess I don't understand this part. The wife cannot get the money anyway until this is signed, so she won't be getting any money at all until it's settled one way or the other.Is there anyway your wife can reason with these girls? I understand they don't like her, but Dad did after all pick her....What do they hope to accomplish by doing this? If they are named beneficarys that's what the Judge is going to order...I can't understand what they 'think' will be different..
What about other items/monies from Dad? Were they able to settle that without probate?

One sister has since signed and the other is playing games. the dads wife has already done alot of things behind our back.She spent the $10,000.00 each that was stated in the will. It just goes on and on with her.my wife was really close to her daddy and this almost broke her.There was nothing we could do but watch him suffer.and die.The worst feeling in the whole world.she has their baby pictures and other stuff thats supposed to be passed down in families. Stuff that she is using for revenge Everyone would get $5000.00 if the sister would just sign.

She spent the $10,000.00 each that was stated in the will.
If your father in law had a will and she did something opposed to that will, your wife, certainly has a case. And I'd probably file it if I were her...I'm sorry there is so much family strife. Unfortunately these things happen way more than they should. Your wife is in my prayers.

Hi, what does the other sister have to say now? Did she ever express her dissatisfaction over the split? I still didn't get the real reason behind her not signing it. Pinkfloydfan

she said why would it matter if the other sister did not sign, I don't know why she changed her mind.about having a case against the dads wife yes they have one but it would cost lots of money to find out all the lies and things she did and then they would get nothing becasue she has spent it all so what would they go after?The house? its stated in the will that it is hers. and it is not paid for and she has tons of medical bills.
