UMBI Pain/Suffering amount owed

First..I'm in TX and I have over $30k in med bills. I had surgery, rehab and may have to have future surgery down the road. The at fault party only had $25k in BI covg, which has paid most of the bills, but not all. My health carrier already paid for some bills, but took their lien out of the BI settlement. I have $5k in PIP coverage. I know my UIMBI covg ($25k) pays for pain & suffering..which will include any possible treatment. I just don't know if I should demand the full amount of $25k? Is that reasonable since I really don't know what the future holds?

Absolutely! From what you have said, I doubt you will have any problem. They should just pay your policy limit and call it a day...and if they don't agree (could be waaaaaay more to it that you can post here)...What's the worse? They say they disagree and then the negotiations begin...

On a side note, do you have more than one vehicle? If so you need to check to find out if TX allows stacking of UIM...Some states do (not many), most don't. Certainly doesn't hurt to ask. If stacking is allowed that means (as an example), if you have four cars, all four have 25/50k UIM, then you would have 100k rather than 25k
