Hi I had a small transport company (two trucks). Last week driver1 over hear driver2 said that he will sue us when he hit himself with the truck. If we get sue what we should do in our defense? and if we got sue, can the government or whomever is involved in this process access to our personal banking accounts? we never ever have any legal problem. we paid all our taxes and we are completely legal with the DOT. We paid about 25,000 a year for trucks insurance (physical, liability and cargo); we can not afford health insurance for drivers; It has no been required for DOT when we got audit (2 times already) No problems with drivers on the past.

I do understand your problem. But I don't think it has got anything to do with health insurance when he's in an accident.You said you'd paid around 25,000 a year with your truck insurance comprising of physical, liability and cargo. Isn't this 'physical' component aimed at covering the physical injuries caused to the driver/passengers in your truck?

First of all I'd get driver one to write out (and sign and date) a statement about what he heard.What EXACTLY happened with driver 2 how did this accident occur etc? Do you have work comp insurance?
