I have two insurance policies on one vehicle...

I have two insurance policies through two different companies on my car. but i only have collision coverage with one of the companies. i was involved in an accident last week, and when i made the claim to have damages taken care of i accidently filed the claim with the policy that doesn't have collision. would it be illegal for me to make the claim with my other policy so i can get my car fixed while i battle it out with the driver that hit me? the other driver is stalling and digging up a fake witness to get out of this whole situation. please. any help would be greatly appreciated.

I don't think there should be any problem in filing a claim with the right one.

Have a question for you, OP. Why would you have 2 DIFFERENT auto insurance policies on the same car? Why not get your Collision coverage through the same Co you have Liability through?

the two just happened to overlap. i still have another month or so wth the policy that has collision. (it was already paid off for the year) I just wanna make sure i don't get dinged for fraud or something. I know it it sounds pretty odd to me, and I'm the one dealing with it so i figured I'd ask someone in the know if this could blow up in my face and get me into trouble
