Is Texas a fault or no fault state? My father recently met with an accident and we are still waiting for the accident report to determine the fault.Thanks...

I was in a car accident, and I was the driver. I was going 5mph under the speed limit and very cautious, when one tire blew out followed by a second one... I had no way of know or expecting this to happen, but yet I was told by the car insurance that drivers are at fault in the state of Texas . My family and myself were serverily injured, and if there was any way to have prevented this I would have, but it was random and unexpected. And it kills me to be told I am at fault for the injuries we all suffered.

Not sure why you posted that in this thread.
_Why_ the tire blew out determines fault. Lacking any info to show it was something in the road I could see where it m might be a maintenance issue if it were one tire. But two tires... that seems to indicate something in the road. Where all of the tires bought at the same time? Can you show that they had some tread left? I'd say it's an easy thing for the adjuster to say you were at fault but if this leads to a rate increase I'd fight it. Also, are you posting this because of UM coverage? It would not apply in this situation.
