I was pulling out of a gas station, and traffic was backed up about 8 cars down, a man was letting me out of the drive way. I looked both ways as I always do before I pulled all the way out. Then out of nowhere a car hit me as I was pulling out in front of the man. The car went around all the other cars on a one lane street, over the double yellow lines I might add, but the police gave me a ticket for "Failure to yield the right of way. Am I at fault? Also I am disputing the ticket but I dont have any witnesses

Sorry, you are at at fault. The other driver crossing the double yellow line has nothing to do with your direction of travel.

In my part of the world we refer to this as "the wave of death". I get at least one of these a month. Honey, sorry you're at fault. Anytime you are entering traffic, you're on it, and NEVER, I mean NEVER take the wave of death unless you can clearly see in all directions.P.S. Good luck fighting that ticket.

Pretty much anytime you are going in reverse to enter traffic you are at fault! Its not fun, I agree!

I wasnt backing out I was pulling out foward and I know that pulling out in traffic usually means its my fault. But its a one lane street traffic doesnt have two or three lanes. So im still not seeing how its my fault if she went around eight cars and its my fault.

I understand that you were pulling out and not reversing, but that still does not change the fact of your failure to yield in the lane of traffic. Whether or not this other driver was in wrong means nothing.

So, what would be his options under the current scenario? Should he look for an attorney now?

For what Pink? He/She pulled from a private drive into traffic (i know someone waved him out). That doesn't change the fact that traffic on that street has the right of way. The poster says, the other vehicle "came out of nowhere" .. well where did he come from? If the poster has no idea, then the road wasn't clear...the other vehicle didn't drop from the sky. That other vehicle (while I don't doubt was inattentive) still had the right of way.
