Does my Insurance company cover a car not on a policy

I sold a car to my daughter and son-in-law. I filed the "Transfer of Ownership and Release of Liability" with California DMV. They did no update the records before my son-in-law had an accident, he was at fault. I have been sued for the damages. My insurance company is defending me but clains they may not have to pay if I am found at fault because we had removed the car from the policy. Should they be required to cover the loss?

Does your son have insurance on the car? If the vehicle was removed from your policy prior to the accident, you need to inform the insurance company about the sale and transer and also have your insurance company communicate the removal of the vehicle from the policy and when the termination occured.

By "They" are you referring to the DMV or the insurance company?

Almost certainly not. You told them to delete the car from the policy. That means no coverage.

The real issue, I assume, is were you, or were you not legally the owner of the car when the accident occured. This will depend on when the California DMV officially considers a title to be transfered. When the papers are filed, or when they are processed.[/quote]

i gave my vehicle to my son and before we got around to do a transfer of ownership he had an accident and to make matters worse my insurance policy had expired on the vehicle. There were damages and people hurt and my son is being accused of the cause of the accident. How can I protect myself, what can I do if anything? Please advise

When a vehicle is sold money usually exchanges hands and the owner signs the title as seller. Did this happen prior to the accident? I can't speak for CA but usually if the prior owner can show the intent to sell (as mentioned above) then the new person is the owner.

Seems like your son was driving without insurance?
