my car is Scion Tc 08
The incident happend two days ago in CA. I was exiting from college parking lot straight, and I got hit from right side. The other driver didn't stop on stop sign.
My insurance company is Mercury. I contacted Mercury, recorded my story. I also called Wawanesa (the other driver's insurance company), and recorded the incident.
After, my insurance adjuster called and recommended to bring my car to their connected body shop (of course they let me know I have other options) rather than go to the other driver's insurance body shop for quicker service. For my injury, he mentioned since I have health insurance, my health insurance pay for my major health bill, and mercury will pay for all of out of pocket money.
Wawanesa's adjuster called me and suggested first call settlement amount of $750, and I didn't know a thing about insurance, so I told him I would accept and he said he will send a mail to get my sign, but later I changed my mind called him that I wouldn't want to accept the offer, and the adjuster said it's okay and I can decide my mind when I get the mail. He said this incident is 100% his insurer's fault.
Since I want to it be done asap, I went the mercury's shop and got estimate. $4900
My back, neck, and left wrist got hurt. I went chiro yesterday, but I still have pain (level of 4~6/10 scale)
Q) Is refusing to accept first settlment good call?
Q) Can I double deep my health bill from my health insurance and from Wawanesa?
Q) How can I get my diminished car value? my car costs $14,225 excellent trade-invalue (kbb) Therefore, the repairement cost is more than 1/3.
Q) Am I going to deal with wawanesa's adjuster? or my adjuster is going to deal with wawanesa's adjuster?
Q) I am full time student, so I don't have income. However, this condition certainly interfere my study. I cannot sit for long time right now, and I cannot do housechore. How can I claim this loss?
This is my first time experience. Please advise me how I can solve this problem wisely.

I live in NY so I am not familiar with your state's laws. If the other driver is 100% at fault, then you need to get a check for your car that covers the full amount to repair it. As for your medical, you have no idea what your long term medical problems will be. I was in an accident in 1987 and my back is worse than ever. So, contact an attorney if you are really hurt. As long as the other insurance company acknowledges that their insured is 100% at fault, then you are entitled to 100% reimbursement to make you whole again. You cannot collect double the amount from yours and their insurance company. You need to be indemnified, meaning that you must recoup your losses and not make money on the deal. A personal injury lawsuit is another story. A good attorney will know how to calculate any loss of earnings you have now or possibly in the future and sue for that amount. Most attorneys offer a free consultation and will take your case at no cost to you but they take 25-33% of the settlement.
