Crossing road from a cross street

A couple of days ago was crossing a 4 lane road from a cross street. The 4 lane road runs North to South. I was crossing from east to west. I crossed two lane without issue and was stopped in the third lane between two cars for traffic to stop and let me cross over the fourth lane. Three cars coming from the north had no issues driving in the forth lane in front of me. None of them stopped but did slow down. Which tells me they did see me. A fourth car driving down the lane hit my bumper. Now the whole time I was stopped, I was yielding to the fourth lane. How does fault work in this case?

Without speaking to the other driver, seeing the police report and possibly speaking to witnesses, I'd say there is negligence on both parties. I'm betting the other person is going to say that you pulled forward into their lane. While you state you were stopped, this will be their statement. It also seems that you were partially into their lane as I doubt they were driving in that 3rd lane. Without knowing more details, there is no good way to say how much liability rests with each party. In some states this will reduce the amount the other person can collect. In other states it will bar recovery from each person.

There is no police report. They asked me several times if I called the police. I responded "no, but you are than welcome to if you want to. We just exchanged insurance information and left. My damage is all on the bumper. They barely had a dent on the left hand corner of their bumper. I am guessing my bumper absorbed most of the impact, since there is no metal, just fiberglass.

If there is a claim then there will be an investigator investigating the entire thing. They have their stipulated ways to determine who is at fault. Why isn't there a police report? Didn't you inform the police?

Since I got the estimates for my car back, I think I am going to have to file a claim. It's a bumper, how bad can it be? I was told 3500. Ouch. I am waiting to hear back form the other driver. I was thinking $1000 to replace the bumper. We both agreed to get estimates and go from there. Nope, no police report. Nobody was hurt. We just exchanged information.
